Progotronics Compilation Terms & Conditions for Participating Artists

Effective Date: June 1st, 2024

Thank you for your interest in participating in the Progotronics compilation series. By submitting your music for inclusion and selecting a specific package, you agree to the following terms and conditions:

1. Eligibility

Participation is open to independent artists and bands who hold the necessary rights to their submitted music.

2. Submission Guidelines

  • Artists must submit high-quality audio files in WAV or MP3 format.
  • Along with the audio submission, artists must provide metadata, including song title, band/artist name, and songwriting credits.
  • All submissions should be original works owned or properly licensed by the submitting artist or band.

3. Participation Tiers and Accompanying Features

Artists can select from the following paid tiers based on the accompanying features:

  1. Song Only: Inclusion of one track on the compilation.
  2. Song + Interview: Inclusion of one track on the compilation and a featured interview.
  3. Song + Interview + Review: Track inclusion, interview, and a professional review.
  4. Song + Interview + Review + EPK: Track inclusion, interview, review, and creation of an Electronic Press Kit (EPK).
  5. Song + Interview + Review + Biography: Track inclusion, interview, review, and a professionally written artist biography.
  6. Full Promotional Package: Comprehensive promotional services, including track inclusion, interview, review, EPK creation, biography, and a targeted promotional campaign.

4. Grant of Rights

By submitting your music, you grant Prog Sphere Promotions a non-exclusive, worldwide, royalty-free license to:

  • Include the submitted track on the Progotronics compilation.
  • Distribute the compilation digitally through Bandcamp and other designated platforms.
  • Use your band/artist name, song title, and related promotional materials (such as album art or press photos) for the marketing and promotion of the compilation and any selected accompanying features.

5. Ownership of Rights

Artists retain full ownership and copyright of their submitted tracks.

6. Payments and Refunds

  • Participation in the Progotronics compilation is subject to the selected tier’s associated fee.
  • Payment is required in full upon submission.
  • Fees are non-refundable, except in cases where Prog Sphere Promotions is unable to fulfill the agreed-upon services.

7. Promotion and Marketing

  • Prog Sphere Promotions will actively promote the compilation through its website, social media channels, and email newsletters.
  • Artists are encouraged to share the compilation and accompanying features with their fanbase to increase exposure.

8. Release and Distribution

  • Prog Sphere Promotions reserves the right to determine the release schedule and distribution channels for the compilation.
  • While efforts will be made to keep the compilation available indefinitely, Prog Sphere Promotions may remove or discontinue the distribution of the compilation at its discretion.

9. Artist Representations and Warranties

By submitting your music, you represent and warrant that:

  • You have the full right, power, and authority to grant the rights described in these Terms & Conditions.
  • The submitted track does not infringe upon any third-party rights, including copyrights, trademarks, or contractual obligations.
  • The track does not contain any illegal, defamatory, or offensive content.

10. Indemnification

Artists agree to indemnify and hold harmless Prog Sphere Promotions, its affiliates, and partners from any claims, damages, or liabilities arising from the inclusion of their music in the compilation or the accompanying features selected.

11. Termination

  • Artists may request the removal of their track from the compilation by providing written notice to Prog Sphere Promotions.
  • Prog Sphere Promotions reserves the right to remove any track from the compilation at its sole discretion.

12. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Türkiye.
